Today the Canadian Association of Professional Immigration Consultants - L'Association
Canadienne des Conseillers Professionnels en Immigration (CAPIC-ACCPI) has the
great pleasure of reminding those in our industry and the public at large of the excellent
work and effort that has been and is being undertaken by professional immigration
consultants.
It is a fact that CAPIC-ACCPI was formed via the coming together of two major forces in
the immigration consulting industry. The Association of Immigration Counsel of Canada
(AICC) and the Organization of Professional Immigration Consultants (OPIC) worked
very hard for more than a decade at great expense to gain a foothold on professional
recognition for immigration consultants.
AICC and OPIC founded the College of Immigration Practitioners of Canada (CIPC)
which was brought into being at the urging of Citizenship and Immigration Canada in
2000 as a possible body responsible for administering a self-regulatory system for
consultants. In 2003 CIC endorsed another body to be the regulator which left the all
important task of membership association to AICC and OPIC. In 2005 the two finally
combined their collective resources and merged into CAPIC-ACCPI via the structure of
the College.
Leaders are leaders because they stand out above or in front of the rest. As such they
garner attention; some warranted and deserving, some inexplicable and undeserved.
Over the last several months several of our members, both present and past, have been
viciously and maliciously attacked in a very public way. The information contained in
these attacks is completely baseless and unfounded. CAPIC-ACCPI views these types of

campaigns and defamatory messages as entirely inappropriate, highly unprofessional,
with suspect intent and as nothing but a scourge causing great damage to the long road of
professionalism that CAPIC-ACCPI and its predecessors have paved.
Completely baseless accusations made to appear as statements of fact such as those
hurled at our former Treasurer, Holly Gracey, are entirely untrue and unfounded. They
are nothing but slanderous and defamatory with malicious intent to cause injury and
damage to the reputation of the individual and to CAPIC-ACCPI and our members.
The actions by the person and those entangled with the person or group that has made
numerous false and damaging statements are reprehensible.

    Now that is democracy. The greatest Canadian Tommy
Douglas said all political parties must have two wings to fly. Accept the fact that others do not agree with your concept of
the truth. Correct your own members errors and shame on you for trying to hide your member’s faults.
Again I find myself forced to stand up for the real Professional Immigration Consultants and write a reply to another
CAPIC policy paper. Why can not CAPIC board members get their facts straight? Is it too hard to understand the rules of
Professional conduct and what should or should not be proper behavior?
Mr. McKay AICC after I ceased to be a board member of that organization passed a rule that forbid any new immigrant
from joining until they had been a permanent resident of Canada for two years. OPIC the other organization you refer to
had similar restrictions placed on its members. This is a clear violation of the Canadian Charter of Rights and Freedoms.
AICC issued licenses to its members without ever testing their knowledge and the current Chair of CSIC John Ryan who
was never tested says this quote on his web site     
     - ! "#John Ryan was not admitted
as a licensed member of AICC. John Ryan came to me with the concept that AICC (we) should give ourselves licenses to
better promote ourselves against other consultants. I stressed that any AICC member should be tested and even offered to
create the test but he and other then AICC board members voted against testing to receive a license and your current
National Vice President Keith Frank and John Ryan paid for a license and received a license with no testing of their
knowledge. Yet CSIC is testing everyone a second time!!!
In your fifth paragraph of your March 29th Policy Paper quote “the information in these attacks are completely
baseless and unfounded” unquote. Maybe I am taking too much credit here but for some reason I think you are referring
to me in this Policy Paper. I also believe you are referring to the board of directors of CSIP. G. W. or Ron I am not
associated with CISP or any other organization other then CSIC.

text contained does not refer to Ms. Holly Gracey can you prove it? If the current Treasurer is the same person as
mentioned in this link who was the CAPIC Treasurer why are you trying to hide this from your members? Show all the

Is it a fact that CAPIC National Vice President received a letter from the Law Society of Upper Canada dated
April 12th 2005 that warned him of possible prosecution if they continue to hold themselves out as lawyers to
the public?
Is it a fact that many of your CAPIC members and some CSIC members advertise on their web sites to
be “Immigration Specialist” in violation to CSIC code of conduct section 11.2? I asked the CSIC manager of
Complaints and Discipline W. Woodman if I could use the term “Immigration Specialist” and was told in no
uncertain terms NO! Yet CAPIC members use that term.
Mr. Bush or should I really say Mr. McKay those who pretend to be professional and have the word
professional in their association name who do nothing to ensure that the consumer is protected by not even
having their own code of conduct are the real reprehensible ones! What have you done to ensure that your own
board members set an example for your own members?
You sir need to read the charter of rights and freedoms because I have a right to associate with what ever group
I wish to and I have a right to my opinion. This week I wrote an email to one of your board members totally
agreeing with him. That does not mean that I am a traitor it means that on that issue or thought we had the same
opinion.
Others who have posted information regarding consultants misleading the public including John Ryan
requesting legal fees is a service to the consumer. Mr. Ryan saw it that way and immediately removed the term.
Mr. Ryan this time acted appropriately.
Your organization on the other hand likes to think you speak for all of the consultants and sir you don’t. It took
me months to get your National Vice President to release a file in a fee dispute and you and your board were of
very little assistance. Always hollow words to protect your money base or your members dues. You Mr. McKay
ensured me in March of 2005 your organization HAD a code of conduct. I am loosing my site but still don’t see
one. Should I post that email you sent me?
I would hate that Mr. McKay would accuse me of saying something unfounded or baseless. Stop trying to
stifle debate and sweep your members faults under the carpet by not disciplining your own.
Tell me you know what the words baseless and unfounded mean?
I am probably wrong but all I see is that most consultant organizations are a means to get money from
consultants to further their own agendas.

On behalf of CSIP and its 5000 members, I congratulate you on assuming charge
of the Office of Citizenship and Immigration of Canada.
. This is the Canadian Society of Immigration Practitioners CSIP, which the largest
regulatory body in Canada and based in Vancouver. were we are practicing/ providing
immigration service under NGO at this current time looks forward to working with you
and the immigration office in bringing about visible and viable changes to the
immigration industry which is presently mired in disrepute and disarray and assist the

Your honourable, I understand that the challenges you face in restructuring the CIC office
and its policy is a challenging one. We believe that your honourable are in the right field
and able to do the right changes after these many years of Liberal neglect and decay are

CSIP however will be proud to work with you in contributing to a better, efficient and
more transparent and responsive departments in particulars Citizenship and Immigration
Department. Immigration and its valuable contribution to the labour force, economic
growth and cultural vitality of Canada are well researched and documented. The question
of immigration being good for Canada is no longer the issue.
The main issue in the Global arena today is how to get the best human talent in the most
suitable manner to contribute to national growth and to offset the negative demographics
that plague all modern economies.
Today due to the harmful effects of undue favouritism
and patronage, extended to CSIC by the former immigration regime, the immigration
industry is beset by infighting and paralysis. Self-regulation of the immigration industry
is no doubt a noble goal, but to hand over monopolistic and dictatorial control of the
entire immigration industry to the former Ministers favourite organizations CSIC and
CAPIC is deplorable and blatantly unfair and unjustified and this is the reason we are
proud to support you in implementing the Accountability Policy immediately.
We look forward Mr. Solberg in resolving the contentious issues that have burdened the
immigration industry in the past, by applying the Accountability Policy. With you now in
the Immigration office and even though you would like to follow the liberal policy on
few issues as you have mentioned on CTV last weekend, However, we believe that one
policy that can not be followed according to the liberal is the creation and the existence of
CSIC.
We look forward to working together with your ministry office, and the Immigration and
Refugee Board and particularly His Honourable David Emerson the Minister of
International Trade and Minister for the Pacific Gateway, and the Vancouver-Whistler
Olympics.
Since we are dealing with foreign investments at the largest scale of its kind
with the Middle East (Dubai) and our project has been presented by the office of the
Honourable premier Mr. Gordon Campbell with the Canada treasury office in Ottawa for
study and approval for the $40 billion dollars project for the 2010 Olympics.
And we are here to support you for a brighter future and to support the immigration industry
as a whole and to provide the financial support to built the 2010 Olympics after we receive
the Federal and Provincial Government approval from his Honorable Mr.David Emerson.

There are non-lawyer businessmen on the Internet who pretend or imply that they are attorneys, when in fact they are not.
Other immigration "consultants", "specialists" or "professionals" Ex- Immigration officers, Counsel, CIC Employment
Counsellor , CIC settlement Counsellor claim to be able to do anything a lawyer can do, when in fact this is not true. CIC
regulations clearly prohibit non-lawyer business firms from representing an immigration petitioner or beneficiary in any manner
before the CIC, the embassies, or any other governmental institution. Many provinces have made “immigration consulting
non-lawyers illegal due to the extensive history of deceit or incompetence by such firms. Furthermore, if you hire one of these
non-lawyer firms below and something goes wrong, there is no Bar Association or any other entity to whom you can seek
redress, nor are such firms restrained in their conduct by fear of a Bar Association complaint or malpractice action by their
“clients”. There is an organization called CSIC , but all the mentioned people below are directors or have conflict of interest
with CSIC directors, so your complaints is invalid against those people.
You should always check a lawyer’s credentials. You can check JohnRya, Ron McKay credentials, or those of his associate
attorney, by calling theLaw society Bar Association at the province they practice. You can check the credentials of any
Canadian attorney Some Bar Associations even have on-line lookup of attorney credentials.

I do admit that you are certainly surprises CSIP everyday with new default of your own regulations. We have just noticed that your website
page paypal, provide the public with the payment method of charging your client with LEGAL SERVICES FEES. Because one of your client just
sent us a receipt that you have charged her with legal services fees which she thought that you are a lawyer!
CSIP investigated her complaint after she received confirmation that You are the one who is hosting the seminars not a registered lawyer of
any law society and just read her attachment clear and no mistake about it.
We want to know under which section of the CSIC regulations that an Immigration consultant is allowed to charge legal services fees for
immigration seminars hosted by yourself as ( Consultant) . Immigration Consultants are somehow confused to follow your step or CSIC
regulations steps. At one point and still to this day, your business cards and your signature use the term " immigration counsel " and now your
payment receipts shows that you do receive payment for " Legal services fees "
Mr. Ryan, please it is a my advice to you and to your clients as of today, is to change CSIC by-law and its regulations in order to fit your
business styles and have all consultants be treated equal. Because you are certainly put yourself out as a lawyer / Counsel no doubt about
this. This makes you again and again in default of your own Regulation which you imposed on CSIC members for the past two years.
We hope by now that you can get the picture that you are as equal as to any Immigration Consultants and you must follow the CSIC
Regulations as well.
Please take notice that we just added this evidence to our complaint with the law Society of upper Canada and in BC and have all the
evidence already sent to them. If you decided to clean your professional act . You can go ahead and do the changes if you feel it is time to
follow your own Regulations so your CSIC members cannot be in default by following your rules. You should be the real model for those
consultants, unfortunately, you are lacking of professionalism and bringing your Society ( CSIC ) into disruptive and shame.
I urge you to read CSIC Regulations since you are in default of every section so far.

a license from the provincial Bar of any province.

the number, and you can call the State Bar where

A person who does immigration papers but is not a
lawyer is called an immigration consultant.
An immigration consultant must obey these laws:

explanation from this individual to assist the consultant in determining whether there is any obligation to report this individual’s conduct.
Conduct Unbecoming an Immigration Consultant”
means conduct in an Immigration Consultant’s personal or private capacity that tends to bring discredit upon the profession including, for example:
(b) taking improper advantage of the youth, inexperience, lack of education, lack of sophistication, ill health, or un-businesslike habits of another;
(c) engaging in conduct involving dishonesty; or
(d) failing to abide by a fee dispute resolution either resolved by the Society or a court of competent jurisdiction.
Officer”
means any person or class of person designated as Officers by the Minister to carry out any purpose of any provision of IRPA.
(e) stating or implying an ability to influence improperly a government agency or official; or

ADVERTISING, SOLICITATION AND MAKING SERVICES AVAILABLE
11.1 An Immigration Consultant should make professional services available to the public in an efficient and convenient manner that will command respect and instil
confidence, and by means that are compatible with the integrity, independence and effectiveness of the profession.
11.2 An Immigration Consultant or his or her Agent shall not engage in false or misleading advertising or representations. In particular, an Immigration Consultant or his or
her Agent shall not misrepresent or mislead a Client as to his or her qualifications, services, fees, available programs or benefits. In addition, an Immigration Consultant or
his or her Agent shall not provide false or unrealistic expectations as to either results or processing times. Under no circumstances shall an Immigration Consultant or his or
her Agent purport to have special access or influence with respect to the Minister, an Officer, or the Board.
11.3 In all instances, advertising should be in good taste and is not such as to bring the profession or the Society into disrepute.

2. Use of the term “guarantee” when describing services or fees is inappropriate, and must be avoided. Wording such as “refund policy” or
reference to contingent fee arrangements, if factual and supported in writing in a retainer agreement or engagement letter, may be
appropriate.
3. An Immigration Consultant has a positive duty to promote the Society and Rules, and to prevent unregulated practice, and is encouraged
where appropriate to educate the public at large regarding the Society and the regulatory system and safeguards with respect to Immigration
Consultants.

4. Former government officials currently acting as Immigration Consultants must take special care to ensure representations regarding their
qualifications and past employment are strictly factual, and must not promote the notion that they may have special access or influence since
any suggestion of special access or influence regarding the immigration process brings the integrity of the immigration process into disrepute.
Furthermore, former immigration officials must abide by and ensure they are in compliance with the Government’s own post-employment rules.
5. An Immigration Consultant shall clearly distinguish his or her own credentials from those of a lawyer licensed to practise law in any province or
territory, and shall not refer to any foreign credential or in any other way make representations that may reasonably lead to a
misapprehension that the Immigration Consultant is a lawyer, provides legal services or has credentials as a lawyer when that is not the case.

I do admit that you are certainly surprises CSIP everyday with new default of your own regulations. We have just noticed that your website page
paypal, provide the public with the payment method of charging your client with LEGAL SERVICES FEES. Because one of your client just sent us a
receipt that you have charged her with legal services fees which she thought that you are a lawyer!
CSIP investigated her complaint after she received confirmation that You are the one who is hosting the seminars not a registered lawyer of any law
society and just read her attachment clear and no mistake about it.
We want to know under which section of the CSIC regulations that an Immigration consultant is allowed to charge legal services fees for immigration

seminars hosted by yourself as ( Consultant) . Immigration Consultants are somehow confused to follow your step or CSIC regulations steps. At one
point and still to this day, your business cards and your signature use the term " immigration counsel " and now your payment receipts shows that you
do receive payment for " Legal services fees "
Mr. Ryan, please it is a my advice to you and to your clients as of today, is to change CSIC by-law and its regulations in order to fit your business styles
and have all consultants be treated equal. Because you are certainly put yourself out as a lawyer / Counsel no doubt about this. This makes you again
and again in default of your own Regulation which you imposed on CSIC members for the past two years.
We hope by now that you can get the picture that you are as equal as to any Immigration Consultants and you must follow the CSIC Regulations as
well.
Please take notice that we just added this evidence to our complaint with the law Society of upper Canada and in BC and have all the evidence already
sent to them. If you decided to clean your professional act . You can go ahead and do the changes if you feel it is time to follow your own Regulations
so your CSIC members cannot be in default by following your rules. You should be the real model for those consultants, unfortunately, you are lacking
of professionalism and bringing your Society ( CSIC ) into disruptive and shame.
I urge you to read CSIC Regulations since you are in default of every section so far.

There are non-lawyer businessmen on the Internet who pretend or imply that they are attorneys, when in fact they are not.
Other immigration "consultants", "specialists" or "professionals" Ex- Immigration officers, Counsel, CIC Employment
Counsellor , CIC settlement Counsellor claim to be able to do anything a lawyer can do, when in fact this is not true. CIC
regulations clearly prohibit non-lawyer business firms from representing an immigration petitioner or beneficiary in any manner
before the CIC, the embassies, or any other governmental institution. Many provinces have made “immigration consulting
non-lawyers illegal due to the extensive history of deceit or incompetence by such firms. Furthermore, if you hire one of these
non-lawyer firms below and something goes wrong, there is no Bar Association or any other entity to whom you can seek
redress, nor are such firms restrained in their conduct by fear of a Bar Association complaint or malpractice action by their
“clients”. There is an organization called CSIC , but all the mentioned people below are directors or have conflict of interest
with CSIC directors, so your complaints is invalid against those people.
You should always check a consultants or lawyer’s credentials. You can check John Ryan's, Ron McKay's credentials, or
those members who are associated with attorney who do not have valid licence , by calling the Law society , Bar Association
at the province they practice. You can check the credentials of any Canadian attorney. Some Bar Associations even have on
line lookup of attorney credentials. CALL also BBB Better business bureau to check on Consultant, do not call CSIC, they will
never give you the correct information.

Know Your Rights!
Anyone offering immigration help must follow certain
laws. These are some of the most important ones:
Any person who says he/she is a lawyer must have
a license from the provincial Bar of any province.
You can ask to see his/her license and write down

(b) taking improper advantage of the youth, inexperience, lack of education, lack of sophistication, ill health, or un-businesslike habits of another;

(d) failing to abide by a fee dispute resolution either resolved by the Society or a court of competent jurisdiction.

11.1 An Immigration Consultant should make professional services available to the public in an efficient and convenient manner that will command respect and instil
confidence, and by means that are compatible with the integrity, independence and effectiveness of the profession.
11.2 An Immigration Consultant or his or her Agent shall not engage in false or misleading advertising or representations. In particular, an Immigration Consultant or his or
her Agent shall not misrepresent or mislead a Client as to his or her qualifications, services, fees, available programs or benefits. In addition, an Immigration Consultant or
his or her Agent shall not provide false or unrealistic expectations as to either results or processing times. Under no circumstances shall an Immigration Consultant or his or
her Agent purport to have special access or influence with respect to the Minister, an Officer, or the Board.
11.3 In all instances, advertising should be in good taste and is not such as to bring the profession or the Society into disrepute.

2. Use of the term “guarantee” when describing services or fees is inappropriate, and must be avoided. Wording such as “refund policy” or
reference to contingent fee arrangements, if factual and supported in writing in a retainer agreement or engagement letter, may be
appropriate.
3. An Immigration Consultant has a positive duty to promote the Society and Rules, and to prevent unregulated practice, and is encouraged
where appropriate to educate the public at large regarding the Society and the regulatory system and safeguards with respect to Immigration
Consultants.
4. Former government officials currently acting as Immigration Consultants must take special care to ensure representations regarding their
qualifications and past employment are strictly factual, and must not promote the notion that they may have special access or influence since
any suggestion of special access or influence regarding the immigration process brings the integrity of the immigration process into disrepute.
Furthermore, former immigration officials must abide by and ensure they are in compliance with the Government’s own post-employment rules.
5. An Immigration Consultant shall clearly distinguish his or her own credentials from those of a lawyer licensed to practise law in any province or
territory, and shall not refer to any foreign credential or in any other way make representations that may reasonably lead to a
misapprehension that the Immigration Consultant is a lawyer, provides legal services or has credentials as a lawyer when that is not the case.
